Mangochi First Grade Magistrate’s Court on Tuesday convicted and sentenced two men each to 10 years imprisonment with hard labour in separate defilement cases.
The convicts are Saizi Saladi, 36, who defiled a three–year–old and Wilfred Moses, 33, for defiling an eight – year – old minor, both contrary to section 138 of the penal code.
Mangochi Police Station prosecutor, Sub Inspector Grace Mindozo told the court that Saladi committed the offence in the afternoon of February 17, 2018 when the three – year – old minor was left alone at home by her mother who went to the market.
“The mother left the little girl with other young girls and went to Chikolomo Market within Mangochi to sell tomatoes,” Mindozo told the court. “The convict took advantage of the mother’s absence and told the victim to follow him to a shop for some sweets but he diverted to his house where he sexually abused the child.”
The matter was first discovered by the mother who noted with shock that her daughter was having difficulties when walking and when she checked on her she found semen and multiple bruises around the genital area, Mindozo added.
She further told the court that the matter was reported to the village headman who mobilised members of community policing forum and Saladi was apprehended and brought to police.
Medical examination report from Mangochi District Hospital confirmed that the minor was indeed defiled.
The court found Saladi guilty and First Grade Magistrate, Ronald M’bwana, therefore, sentenced him to 10 years imprisonment with hard labour to deter others from committing a similar offence.
However, in the second case the court heard from police prosecutor Sub Inspector Maxwell Mwaluka that the incident took place in the evening of February 10, 2018 when the eight – year – old girl and her nine – year – old friend were coming back from a disco that took place within Kadango Village in the district.
Moses, the court heard, grabbed the little girl and dragged her to the nearest bush where he forcibly engaged in sexual intercourse with her and gave her a packet of Kamba puffs which she refused.
The matter was reported to Namalaka Police Unit where the victim was issued with a medical report and the results from Namalaka Health Centre confirmed that she was indeed defiled and Moses was arrested.
Magistrate M’bwana slapped Moses with a custodial sentence of 10 years imprisonment with hard labour for the same reasons he slapped Saladi for.
Moses hails from Likala Village in the area of Traditional Authority Chimwala while Saladi comes from Chiwaya Village in the area of Traditional Authority Chowe.
